Terms of Service

1. Definitions
In these Terms of Service, the following terms shall have the meanings ascribed to them below:
- Platform / Site
- the Praca.ua website, available at https://praca.ua, including all subdomains, mobile versions, API, and integrated services.
- Administrator / Praca.ua
- Praca.ua, a sole proprietorship registered in Ukraine. Address: Lutsk, Ukraine. Contact: support@praca.ua.
- User
- any natural or legal person who uses the Platform, regardless of registration status.
- Job Seeker
- a natural person who uses the Platform to search for employment, create a CV, or apply to job vacancies.
- Employer
- a legal entity or sole proprietorship that publishes job vacancies on the Platform.
- Job Vacancy
- an advertisement for an available position, published by an Employer.
- AI Features
- automated systems based on artificial intelligence used on the Platform, including: AI job search, AI recommendations, AI CV creation, AI matching of candidates and vacancies.
- Paid Services
- services provided on a fee basis, including: premium subscriptions, paid job postings, featured vacancies, etc.
- Content
- any information, data, texts, images, or files uploaded by Users to the Platform.
- DSA
- EU Regulation 2022/2065 on Digital Services (Digital Services Act).
- GDPR
- EU Regulation 2016/679 on the protection of personal data (General Data Protection Regulation).
2. General Provisions
- These Terms of Service (hereinafter referred to as the "Terms") govern the relationship between Praca.ua (the "Administrator") and Users of the Platform.
- By using the Platform, the User confirms that they have read, understood, and agree to be bound by these Terms.
- If the User does not agree to these Terms, they must immediately cease using the Platform.
- The Platform acts as an intermediary (hosting provider) within the meaning of the DSA and is not a party to the employment relationship between Job Seekers and Employers.
- The minimum age for using the Platform is 16 years. Persons under 16 years of age may use the Platform only with the consent of a parent or legal guardian.
- The Platform is provided "as is". The Administrator does not guarantee uninterrupted operation or the absence of technical errors.
- These Terms constitute a public offer. By registering or using the Platform, the User accepts this offer.
3. Language, Jurisdiction, Applicable Law
- These Terms are concluded in Ukrainian. Versions in Polish and English are also available. In case of discrepancies between language versions, for Job Seekers who are consumers, the version in the language chosen by the User at registration prevails. For Employers and other legal entities, the Polish version prevails.
- The relationship between Praca.ua and Users shall be governed by the law of the Republic of Poland if the User is located within the EU. For Users located outside the EU, the law of Ukraine shall apply.
- All disputes between Praca.ua and Job Seekers (natural persons acting as consumers) shall be resolved in the court of the consumer's place of residence. Any arbitration clauses restricting this right are null and void.
- Disputes between Praca.ua and Employers (legal entities) shall be resolved by the District Court of Warsaw, Poland, or by the Arbitration Court at the Krajowa Izba Gospodarcza (SA KIG) in Warsaw, at Praca.ua's option.
- The parties undertake to take steps for pre-trial dispute resolution by sending a written claim. The claim review period shall be 30 days from the date of receipt.
4. Registration and Account
- Registration on the Platform is voluntary. No registration is required to browse job vacancies.
- Registration is required to publish job vacancies and use certain features.
- Registration may be completed using: email, phone number, Facebook Login, or Google OAuth.
- Facebook Login: When logging in via Facebook, Praca.ua gains access to the public profile (name, email, profile photo) in accordance with the permissions granted by the User on Facebook. Praca.ua does not publish anything on Facebook on behalf of the User and does not collect friends' data.
- The User undertakes to provide accurate information upon registration and to keep it up to date.
- The User is responsible for maintaining the confidentiality of their password. Praca.ua shall not be liable for unauthorised access caused by the User's negligence.
- One natural person may have only one account, unless otherwise agreed with the Administrator.
- Know Your Business Customer (Employer verification): In accordance with Art. 30 DSA, the Employer must provide prior to registration: full name, registered address, email address, phone number, registration number (KRS/NIP/ЄДРПОУ) or other identifier. Failure to provide this data is grounds for refusal of registration.
- Creating accounts for automated data collection (scraping), spam distribution, or other unlawful activities is prohibited.
5. Employer Rights and Obligations
- The Employer has the right to publish Job Vacancies in accordance with the Platform's functionality.
- The Employer undertakes to publish only genuine Job Vacancies that reflect actual positions. Posting fake vacancies or collecting candidate data without a genuine intention to hire constitutes a violation of these Terms and may be qualified as fraud.
- It is prohibited to post Job Vacancies that discriminate on grounds of race, colour, sex, age, religion, nationality, disability, sexual orientation, or any other characteristic protected under Polish law (Kodeks Pracy, Art. 183³) and EU law.
- The Employer undertakes not to collect candidates' personal data outside the Platform's mechanisms.
- The Employer bears full responsibility for the content of published Job Vacancies.
- The Employer undertakes to update the status of Job Vacancies (close/deactivate after hire).
- Certain categories (premium placements) may be subject to additional terms, which shall be communicated to the Employer before payment.
6. Job Seeker Rights and Obligations
- The Job Seeker has the right to browse Job Vacancies, create a CV, apply to Job Vacancies, and subscribe to notifications free of charge.
- The Job Seeker undertakes to provide accurate information in their CV and when applying to Job Vacancies.
- Creating fake accounts, sending spam, or manipulating ratings or reviews is prohibited.
- The Job Seeker has the right to delete their account and personal data at any time in accordance with the GDPR.
7. AI Features
7.1 List of AI Features
The Platform uses the following AI features:
- AI Job Search — semantic search that analyses the query text and matches the most relevant Job Vacancies;
- AI Recommendations — personalised job suggestions based on the Job Seeker's profile and search history;
- AI CV Creation — an assistive tool for creating a structured CV based on entered data;
- AI Matching — automatic matching of candidates and Job Vacancies for Employer recommendations.
7.2 Transparency and Information
In accordance with the EU AI Act (Art. 26(7)), Praca.ua informs Users about the use of AI features. The User has the right to know when they are interacting with an AI system, how it works, and how it affects outcomes.
7.3 Human Oversight
Praca.ua's AI systems are assistive tools. No candidate selection decision is made solely by AI. The Employer receives recommendations and explanations, but the final hiring decision is made by a human. The AI matching system is considered high-risk under the EU AI Act (Annex III, point 4).
7.4 Right to Explanation
The User has the right to receive an explanation regarding decisions made with the involvement of AI systems: why a particular Job Vacancy was recommended, why a candidate was deemed suitable or unsuitable. Requests for explanations shall be sent to ai@praca.ua.
7.5 Prevention of Discrimination
Praca.ua takes measures to detect and eliminate bias in AI models. Regular auditing of AI systems for discrimination is mandatory. Incidents of discrimination may be reported to ai@praca.ua.
7.6 Limitation of Liability for AI
AI features are provided as assistive tools. Praca.ua does not guarantee 100% accuracy of AI recommendations. The Employer bears responsibility for final hiring decisions.
8. Paid Services
- Paid Services are available exclusively to Employers (legal entities and sole proprietorships).
- The list, pricing, and terms of Paid Services are published on a separate page and form an integral part of these Terms.
- Payment shall be made in accordance with the issued invoice. Prices are quoted in PLN or EUR and include taxes in accordance with Polish law.
- Right of withdrawal: For Job Seekers who are consumers, the right to withdraw from Paid Services applies within 14 days from the date of payment (Art. 27 of the Polish Consumer Rights Act). This right does not apply if the service has been fully performed before the withdrawal period expires (Art. 38 of Directive 2011/83/EU).
- Automatic subscription renewal: Premium subscriptions are renewed automatically unless the User cancels before the expiry date. The User shall be notified of automatic renewal no later than 7 days before the charge date.
- In the event of a breach of these Terms, Praca.ua has the right to suspend the provision of Paid Services without a refund.
- Praca.ua does not provide employment placement services. Paid Services consist of the technical posting and promotion of Job Vacancies on the Platform.
9. Intellectual Property
- The Praca.ua Platform, its design, code, databases, logos, and trademarks are the intellectual property of Praca.ua and are protected by the laws of Ukraine, Poland, and the EU.
- Content posted by Employers (job vacancy texts, company descriptions, images) remains their property. By posting Content, the Employer grants Praca.ua a free, non-exclusive licence to use, reproduce, and display the Content on the Platform for the purposes of providing services.
- Content created using AI features (e.g., AI-generated CVs) belongs to the User who created it.
- Copying, reproduction, distribution, or use of Platform Content without the written consent of Praca.ua is prohibited, except for personal non-commercial use.
- Automated data collection (scraping, parsing) from the Platform without written permission is strictly prohibited.
10. Prohibited Content and Actions
- The following are prohibited on the Platform:
- fake, misleading, or fraudulent Job Vacancies;
- Job Vacancies that discriminate against candidates;
- content that infringes the copyrights of third parties;
- spam, phishing links, or malicious code;
- content promoting violence, hatred, or illegal activity;
- personal data of third parties without their consent;
- content that violates the laws of Poland, Ukraine, or the EU.
- Prohibited User actions:
- creating multiple accounts for the purpose of manipulation;
- automated data collection (scraping);
- sending unsolicited messages to other Users;
- attempts to hack or perform penetration testing without authorisation;
- using the Platform for any unlawful activity.
- Upon detection of prohibited content or actions, Praca.ua has the right to:
- remove the Content without prior notice;
- suspend or block the account;
- notify law enforcement authorities;
- terminate the agreement unilaterally.
11. Complaint Mechanism (Notice-and-Action)
- In accordance with Art. 16 DSA, Praca.ua provides a mechanism for reporting illegal content or actions on the Platform.
- A notice may be submitted by any person via the form at praca.ua/praca/complaint/ or by email to abuse@praca.ua.
- The notice must contain:
- a link to the specific Content or profile;
- a justification as to why the Content is considered illegal;
- the contact details of the complainant;
- a statement of good faith.
- Praca.ua reviews notices within 14 calendar days and informs the complainant of the decision taken (removal, rejection, correction).
- The User whose Content has been removed has the right to appeal the decision within 30 days via the appeal form.
- Praca.ua publishes an annual transparency report with information on notices received and processed (Art. 42 DSA).
12. Liability
- Praca.ua is a hosting provider (intermediary service provider) within the meaning of the DSA and is not liable for the content of Job Vacancies posted by Employers, provided that:
- it has no actual knowledge of illegal Content (Art. 5 DSA);
- it acts expeditiously upon receiving a notice of illegal Content;
- it properly verifies Employers (Art. 30 DSA).
- Praca.ua is not a party to the employment relationship between Job Seekers and Employers and is not liable for:
- working conditions, wages, or work schedules;
- the accuracy of information provided by Employers;
- refusal to hire or any other personnel decisions;
- actions of Employers after contacting a Job Seeker.
- Limitation of liability: To the maximum extent permitted by law, Praca.ua's liability to the User shall be limited to the amount paid by the User for Paid Services during the 12 months preceding the event giving rise to the claim.
- For Job Seekers who are consumers, limitations of liability do not apply in cases provided for in Art. 385³ of the Polish Civil Code (intentional harm, personal injury, breach of essential contractual terms).
- Praca.ua shall not be liable for temporary unavailability of the Platform due to maintenance, force majeure, or acts of third parties.
- Links to external websites in Job Vacancies do not imply Praca.ua's endorsement of those sites.
13. Privacy Policy and Data Protection
- The processing of Users' personal data is carried out in accordance with the Privacy Policy, which forms an integral part of these Terms.
- The controller of personal data within the meaning of the GDPR is Praca.ua. For data protection matters: privacy@praca.ua.
- The Platform's servers are located within the European Union (DigitalOcean, Poland/Netherlands). Data transfer to Ukraine is governed by the European Commission's Standard Contractual Clauses (SCCs).
- The User has the right to: access, rectification, erasure, restriction of processing, data portability, objection to processing, and withdrawal of consent.
- Data retention period: active account data is retained for the duration of Platform use plus 3 years after the last activity. After account deletion, data is deleted within 30 days, except for data that Praca.ua is required by law to retain (financial records, etc. — up to 5 years).
- When using Facebook Login, Facebook is a joint data controller. The User may manage permissions in their Facebook account settings.
14. Cookies and Similar Technologies
- The Platform uses cookies to ensure functionality, analytics, and personalisation.
- Strictly necessary (technical) cookies do not require consent. Non-essential (analytical, marketing) cookies are used only with the User's consent.
- The User may manage cookie settings via the browser or the cookie panel on the Platform. Refusing non-essential cookies is no less convenient than giving consent.
- Detailed information about cookie types, their purposes, and retention periods is available in the Privacy Policy.
15. Account Termination and Deletion
- The User has the right to delete their account at any time via the profile settings or by sending a request to support@praca.ua.
- Praca.ua has the right to suspend or delete a User's account in cases of:
- breach of these Terms;
- inactivity exceeding 3 years;
- request from law enforcement authorities;
- technical necessity.
- Upon account deletion, Praca.ua shall delete the User's personal data within 30 days, except for data that must be retained by law (financial records, etc. — up to 5 years).
- Account deletion does not affect services already provided. Paid Services rendered prior to deletion are non-refundable.
- After account deletion, Job Vacancies, CVs, and other Content may be deleted or anonymised.
16. Changes to Terms
- Praca.ua has the right to amend these Terms unilaterally. Users shall be notified of changes no later than 14 days before the new version takes effect.
- Notice of changes shall be sent to the User's email address and/or published on the Platform.
- If the User does not agree with the new version, they have the right to terminate the agreement without penalty before the effective date of the changes.
- Continued use of the Platform after the changes take effect constitutes the User's acceptance of the new version.
17. Dispute Resolution
- Consumers (Job Seekers): Disputes shall be resolved by a court of general jurisdiction at the consumer's place of residence. Pre-trial settlement: the User sends a claim to support@praca.ua, Praca.ua reviews it within 30 days.
- Employers (legal entities): Disputes shall be resolved by the District Court of Warsaw, Poland. Polish substantive law shall apply.
- Paid Services: For disputes regarding Paid Services exceeding 10,000 PLN, the parties may agree to submit the dispute to the Arbitration Court at the Krajowa Izba Gospodarcza (SA KIG) in Warsaw in accordance with its rules.
- Praca.ua does not participate in out-of-court consumer dispute resolution (ADR) procedures but may agree to mediation by mutual consent.
- For Users from the EU, the ODR (Online Dispute Resolution) platform is available at: https://ec.europa.eu/consumers/odr/.
18. Final Provisions
- These Terms shall take effect on 20 June 2026 and shall remain in force for an indefinite period.
- If any provision of these Terms is found to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.
- Praca.ua's waiver of any right under these Terms shall not constitute a waiver of that right in the future.
- The User may not transfer their rights and obligations under these Terms to third parties without the written consent of Praca.ua.
